Le Contenu et les Services du site internet www.iammyownlegend.com (le « Site ») sont fournis par I AM MY OWN LEGEND, LLC, une société à responsabilité limitée du Delaware ayant son siège social à l'adresse suivante :

Les présentes Conditions Générales d'Utilisation (ci-après « CGU ») ont pour objet de définir les règles d'utilisation du Site et des Services par l'Utilisateur, ainsi que les obligations de la société I AM MY OWN LEGEND, LLC.

L'utilisation du Site ne nécessite pas la création d'un compte, sauf pour l'utilisation des Contenus payants et des Espaces Interactifs mis à la disposition des Membres. En tout état de cause, les Utilisateurs et les Membres s'engagent, lors de chacune de leurs visites sur le Site, à respecter les présentes CGU, qui s'appliquent à l'ensemble des produits, Services et Contenus du Site, qu'ils soient fournis gratuitement ou achetés individuellement ou en package.  

Les présentes CGU s'imposent à l'Utilisateur qui reconnaît, en cochant la case prévue à cet effet, en avoir pris connaissance et les avoir acceptées intégralement et sans réserve avant toute commande de formation, consultation d'information, et/ou simple utilisation gratuite du Site.

I AM MY OWN LEGEND s'efforce d'améliorer constamment ses Services et de développer de nouvelles fonctionnalités afin d'offrir à ses Utilisateurs une meilleure expérience d'utilisation du Site et de son Contenu. A cet égard, I AM MY OWN LEGEND peut être amenée à mettre à jour les présentes CGU. I AM MY OWN LEGEND informera ses Utilisateurs par tout moyen, par exemple par email ou via ses Services, avant de modifier les présentes CGU. Les Utilisateurs pourront ainsi en prendre connaissance. Une fois les CGU révisées entrées en vigueur, les Utilisateurs seront contractuellement liés par celles-ci s'ils souhaitent continuer à utiliser les Services du Site.

I AM MY OWN LEGEND se réserve le droit de modifier, supprimer ou désactiver tout ou partie des Services proposés sur le Site, à tout moment et sans avoir à fournir de justification.

Définitions

Administrateur(s) : désigne toute personne chargée de la gestion du Site et de la bonne conduite des Utilisateurs conformément aux présentes CGU.

Contenu(s) : désigne, sans que cette liste soit limitative, la structure, l'architecture des Services, le contenu éditorial, les vidéos, textes, images, sons, dessins, illustrations, photographies, rubriques, actualités, FAQ, liens hypertextes, tout jeu, et tout autre contenu présent et/ou composant les Services du Site, ainsi que tout autre contenu publié sur les Réseaux Sociaux de I AM MY OWN LEGEND.  

Espaces Interactifs : désigne les espaces mis à la disposition des Utilisateurs sur les Services du Site, incluant notamment les forums et espaces de commentaires.

Membre(s) : désigne un Utilisateur s'étant identifié sur le Site grâce à son adresse email et à un mot de passe personnel, cette identification permettant d'accéder à certains Contenus ou Services particuliers proposés par I AM MY OWN LEGEND et de bénéficier d'autres fonctionnalités réservées.

Réseaux Sociaux : désigne les sites, tels que Facebook, Twitter, YouTube et Instagram, sur lesquels I AM MY OWN LEGEND dispose d'un compte à son nom et publie du Contenu. Ces sites ont pour vocation de favoriser les interactions sociales entre I AM MY OWN LEGEND et ses Utilisateurs. Le terme « Réseaux Sociaux » désigne également toutes les plateformes rendant possibles ces interactions.

Service(s) : désigne le(s) service(s) édité(s) par I AM MY OWN LEGEND et accessible(s) depuis le Site ou les Réseaux Sociaux sur lesquels I AM MY OWN LEGEND est inscrit.

Site : désigne le site internet www.iammyownlegend.com.

Utilisateur(s) : désigne toute personne qui utilise le Site, les Services et les Contenus proposés sur le Site ou sur les Réseaux Sociaux sur lesquels I AM MY OWN LEGEND est inscrit.

Obligations de l'Utilisateur

Les Services de I AM MY OWN LEGEND, ainsi que tout contenu disponible via notre Service, sont réservés à un usage personnel et non commercial. Les Membres s'engagent à ne pas utiliser le Service pour des représentations publiques.  

L'Utilisateur et/ou le Membre s'engage à ne pas utiliser le compte d'un autre Utilisateur et/ou Membre et à ne pas fournir ses codes d'accès (adresse email et mot de passe) à une autre personne pour accéder à son compte. L'Utilisateur et/ou le Membre est entièrement responsable de toutes les activités qui se déroulent sous son mot de passe ou son compte, et il lui appartient de veiller à ce que son mot de passe reste confidentiel et sécurisé. L'Utilisateur et/ou le Membre s'engage à notifier immédiatement I AM MY OWN LEGEND de toute utilisation non autorisée de son mot de passe ou de son compte ou de toute autre violation de sécurité, et à s'assurer qu'il se déconnecte de son compte à la fin de chaque session lorsqu'il accède aux Services. I AM MY OWN LEGEND ne sera pas responsable de toute perte ou dommage résultant du non-respect de la présente section par l'Utilisateur et/ou le Membre.  

L'Utilisateur et/ou le Membre s'engage à ne pas modifier, reproduire ou pirater le Site et/ou à ne pas modifier ou créer un autre site web de manière à induire en erreur les clients potentiels et à leur faire croire que ce site web est associé aux Services de I AM MY OWN LEGEND.  

L'Utilisateur et/ou le Membre s'engage à ne pas reproduire, dupliquer, copier, vendre, revendre ou exploiter toute partie du Site, l'utilisation du Site ou l'accès au Contenu.  

Publications des Membres sur le Site I AM MY OWN LEGEND

Dans le cadre de l'utilisation du Site et de ses Services de publication, I AM MY OWN LEGEND agit en qualité d'hébergeur de contenus. Les Membres qui publient du contenu sur le Site ou sur les Espaces Interactifs mis à disposition par I AM MY OWN LEGEND sont seuls responsables de la reproduction et de la diffusion de leurs publications, notamment les textes, images, sons et séquences audiovisuelles qu'ils choisissent de publier. Ainsi, les Membres qui publient du contenu sur le Site doivent se conformer aux dispositions légales et réglementaires en vigueur, et à ce titre, garantissent I AM MY OWN LEGEND contre tout recours de tiers.  

En particulier, le Membre s'engage à ce que ses publications ne contiennent rien qui puisse violer les lois et autres dispositions relatives à la diffamation et l'injure, au droit au respect de la vie privée et à l'image, à l'ordre public et aux bonnes mœurs (notamment, et sans que cette liste soit limitative, apologie de crimes contre l'humanité, incitation à la haine raciale, contenus violents, incitation au terrorisme, pornographie, violation de la réglementation sur la protection des données personnelles, etc.) et/ou à la contrefaçon. Le Membre garantit que le contenu qu'il publie ne contient aucun élément emprunté à une autre œuvre susceptible d'engager la responsabilité de I AM MY OWN LEGEND.  

En cas de non-respect des engagements susvisés, et notamment en cas de réclamation d'un tiers sous forme de notification, I AM MY OWN LEGEND se réserve le droit de désactiver, sans formalité ni information préalable du Membre concerné, tout contenu publié par celui-ci sur le Site.

En tout état de cause, I AM MY OWN LEGEND ne saurait en aucun cas être tenue responsable des publications des Membres sur le Site.

Le contenu créé et partagé par un Membre via le Site lui appartient. Le Membre ne concède aucun droit d'exploitation exclusif à I AM MY OWN LEGEND. Le Membre peut ainsi retirer le contenu à tout moment pour le rendre inaccessible. Toutefois, le Membre accepte que le Site puisse stocker, utiliser et diffuser ses publications dans le cadre des Services et de la finalité du Site, notamment sur le Site et les comptes de Réseaux Sociaux de I AM MY OWN LEGEND. Le Membre accepte que ses publications puissent, pendant leur durée de présence sur le Site, être accompagnées ou faire l'objet de l'insertion de tous logos, marques, textes ou séquences audiovisuelles, notamment publicitaires.

Relations entre les Utilisateurs et/ou Membres du Site

Les Utilisateurs et/ou Membres s'engagent à échanger et publier leurs contenus sur les pages des Réseaux Sociaux de I AM MY OWN LEGEND et, le cas échéant, sur les Espaces Interactifs de manière raisonnable, en toute bonne foi, et en veillant au respect des libertés d'autrui.

Les contenus publiés par les Membres sur le Site et/ou les Espaces Interactifs et les contenus publiés par les Utilisateurs et/ou Membres sur les Réseaux Sociaux de I AM MY OWN LEGEND relèvent de leur seule responsabilité.  

En cas d'abus

Les Utilisateurs et/ou Membres peuvent signaler tout contenu illicite.

La notification des activités prétendument illicites peut être adressée à I AM MY OWN LEGEND par email à haitika@iammyownlegend.com

Accessibilité et maintenance du Site

I AM MY OWN LEGEND s'efforcera dans la mesure du possible de garantir la disponibilité du Site et des Services, sauf cas de force majeure ou survenance d'un événement hors du contrôle de I AM MY OWN LEGEND, et sous réserve des pannes et interventions de maintenance nécessaires au bon fonctionnement du Site. Les interventions de maintenance pourront être effectuées sans information préalable des Utilisateurs.

TERMS OF USE

The Content and Services of the website www.iammyownlegend.com (the "Site") are provided by I AM MY OWN LEGEND, LLC, a Delaware limited liability company with a registered address at:

These Terms of Use (hereinafter "ToU") are intended to establish the rules for the use of the Site and Services by the User, as well as the obligations of I AM MY OWN LEGEND, LLC.

Use of the Site does not require the creation of an account, except for the use of paid Content and Interactive Spaces made available to Members. In any case, Users and Members undertake, during each of their visits to the Site, to comply with these ToU, which apply to all products, Services, and Content of the Site, whether provided free of charge or purchased individually or in a package.

These ToU are binding on the User, who acknowledges, by checking the box provided for this purpose, having read and accepted them fully and without reservation before any order of a training, consultation of information, and/or simple free use of the Site.

I AM MY OWN LEGEND strives to constantly improve its Services and develop new features to offer its Users a better experience in using the Site and its Content. In this regard, I AM MY OWN LEGEND may update these ToU. I AM MY OWN LEGEND will inform its Users by any means, for example by email or through its Services, before modifying these ToU. Users will thus be able to review them. Once the revised ToU come into effect, Users will be contractually bound by them if they wish to continue using the Site's Services.

I AM MY OWN LEGEND reserves the right to modify, remove, or disable all or part of the Services offered on the Site, at any time and without having to provide any justification.

Definitions

Administrator(s): means any person in charge of the management of the Site and the proper conduct of Users in accordance with these ToU.

Content(s): means, but is not limited to, the structure, architecture of the Services, editorial content, videos, texts, images, sounds, drawings, illustrations, photographs, sections, news, FAQs, hyperlinks, any games, and any other content present and/or comprising the Services of the Site, and any other content published on the Social Networks of I AM MY OWN LEGEND.

Interactive Spaces: means the spaces made available to Users on the Site's Services, including, but not limited to, forums and comment sections.

Member(s): means a User who has identified themselves on the Site with their email address and personal password, this identification allowing access to certain Content or special Services offered by I AM MY OWN LEGEND and to benefit from other reserved features.

Social Networks: means sites, such as Facebook, Twitter, YouTube, and Instagram, on which I AM MY OWN LEGEND has an account in its name and publishes Content. These sites are intended to foster social interactions between I AM MY OWN LEGEND and its Users. The term "Social Networks" also refers to all platforms that make these interactions possible.

Service(s): means the service(s) published by I AM MY OWN LEGEND and accessible from the Site or the Social Networks on which I AM MY OWN LEGEND is registered.

Site: means the website www.iammyownlegend.com.

User(s): means any person who uses the Site, the Services, and Content offered on the Site or on the Social Networks on which I AM MY OWN LEGEND is registered.

User Obligations

The I AM MY OWN LEGEND Services, as well as any content available through our Service, are for your personal and non-commercial use only. Members agree not to use the Service for public performances.

The User and/or Member agrees not to use the account of another User and/or Member and not to provide their access codes (email address and password) to another person to access their account. The User and/or Member is fully responsible for all activities that occur under their password or account, and it is their responsibility to ensure that their password remains confidential and secure. The User and/or Member agrees to immediately notify I AM MY OWN LEGEND of any unauthorized use of their password or account or any other breach of security, and to ensure that they log out of their account at the end of each session when accessing the Services. I AM MY OWN LEGEND will not be liable for any loss or damage arising from the User's and/or Member's failure to comply with this section.

The User and/or Member agrees not to modify, reproduce, or hack the Site and/or not to modify or create another website so as to mislead potential customers and make them believe that this website is associated with the I AM MY OWN LEGEND Services. The User and/or Member agrees not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, use of the Site, or access to the Content.

Member Publications on the I AM MY OWN LEGEND Site

In the context of the use of the Site and its publication Services, I AM MY OWN LEGEND acts as a content host. Members who publish content on the Site or on the Interactive Spaces made available by I AM MY OWN LEGEND are solely responsible for the reproduction and distribution of their publications, including texts, images, sounds, and audiovisual sequences that they choose to publish. Thus, Members who publish content on the Site must comply with the legal and regulatory provisions in force, and in this respect, shall indemnify I AM MY OWN LEGEND against any third-party action.

In particular, the Member agrees that their publications do not contain anything that could violate laws and other provisions relating to defamation and insult, privacy and image rights, public order and morality (including, but not limited to, justification of crimes against humanity, incitement to racial hatred, violent content, incitement to terrorism, pornography, violation of regulations on the protection of personal data, etc.) and/or infringement. The Member warrants that the content they publish does not contain any material borrowed from another work that could engage the liability of I AM MY OWN LEGEND.

In the event of non-compliance with the commitments mentioned above, and in particular in the event of a third-party complaint in the form of a notification, I AM MY OWN LEGEND reserves the right to deactivate, without formality or prior information to the Member concerned, any content published by them on the Site.

In any event, I AM MY OWN LEGEND shall under no circumstances be held liable for the publications of Members on the Site.

The content created and shared by a Member through the Site belongs to them. The Member does not grant any exclusive exploitation rights to I AM MY OWN LEGEND. The Member may thus remove the content at any time to make it inaccessible. However, the Member agrees that the Site may store, use, and disseminate their publications within the framework of the Services and the purpose of the Site, in particular on the Site and the Social Network accounts of I AM MY OWN LEGEND. The Member agrees that their publications may, during their lifetime on the Site, be accompanied by or be subject to the inclusion of any logos, trademarks, texts, or audiovisual sequences, including advertising.

Relationships between Users and/or Members of the Site

Users and/or Members agree to exchange and publish their content on the pages of the I AM MY OWN LEGEND Social Networks and, where applicable, on the Interactive Spaces in a reasonable manner, with perfect goodwill, and ensuring respect for the freedoms of others.

The content published by Members on the Site and/or Interactive Spaces and the content published by Users and/or Members on the I AM MY OWN LEGEND Social Networks are their sole responsibility.

In Case of Abuse

Users and/or Members may report any illegal content. Notice of alleged illegal activities may be sent to I AM MY OWN LEGEND by email at haitika@iammyownlegend.com

Accessibility and Maintenance of the Site

I AM MY OWN LEGEND will use commercially reasonable efforts to ensure the availability of the Site and Services, except in cases of force majeure or the occurrence of an event beyond the control of I AM MY OWN LEGEND, and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the Site. Maintenance interventions may be carried out without prior notice to Users.  

I AM MY OWN LEGEND cannot guarantee the continuity, accessibility, and absolute security of the Services.

Liability of I AM MY OWN LEGEND and Force Majeure

The User or Member expressly acknowledges that they use the Site and its Services at their own and entire risk.

I AM MY OWN LEGEND shall in no event be liable for any direct or indirect damages, whatever their nature, resulting from the unavailability or failure of the Site or its Services, the loss of data or Content, or resulting from the presence of viruses on the Site, except for damages that would be caused by a breach of its obligations. It is the responsibility of the Member to keep a copy of what they have published on the Site and of the User or Member to keep a copy of what they have published on the pages of the I AM MY OWN LEGEND Social Networks.

I AM MY OWN LEGEND shall not be held responsible for the contractual or non-contractual relationships between partners/advertisers and Users and/or Members of the Site and its Services. I AM MY OWN LEGEND shall not be held responsible for the exchanges and relationships of Users and/or Members among themselves or for the exchanges and relationships between Users and/or Members and the speakers within the training courses.

I AM MY OWN LEGEND shall not be held responsible for any total or partial non-performance that has its origin in a case of force majeure, constituted by any event having the characteristics of unpredictability, irresistibility, and exteriority as recognized by applicable law, including, without this list being considered exhaustive, cases of wars, internal or external strikes, riots, storms, earthquakes, floods, fires, technical failures, as well as for any fortuitous events.

I AM MY OWN LEGEND shall not be held responsible for any total or partial non-performance that has its origin in a fact beyond its control.

Intellectual Property of I AM MY OWN LEGEND

All documents, information, texts, audiovisual sequences, graphics, images, illustrations, comments, photographs, or any other Content, published on the Site or on Social Networks via the accounts of I AM MY OWN LEGEND by I AM MY OWN LEGEND are the exclusive property of I AM MY OWN LEGEND and are reserved for the use of I AM MY OWN LEGEND. The same applies to titles, trademarks, screenshots, names, or logos belonging to I AM MY OWN LEGEND.

Consequently, these elements may not be modified, reproduced, exploited, or used in any way by the User or a Member. Any reproduction or representation of any of the aforementioned elements requires the prior written authorization of I AM MY OWN LEGEND. Camouflaging or removing logos and cropping are also prohibited.

Any reproduction, distribution, or modification of these elements without the prior written authorization of I AM MY OWN LEGEND exposes the offenders to legal action.

The User or Member agrees not to sell, assign, license, sublicense, pledge, or otherwise transfer the elements listed in this paragraph 6.

Hyperlinks

10.1 The Site may contain hyperlinks to other websites over which I AM MY OWN LEGEND has no control. Despite prior and regular checks carried out by I AM MY OWN LEGEND, I AM MY OWN LEGEND disclaims all liability for the content that Users or Members may find on these sites.

Users and Members are solely responsible for the use of the content of third-party websites to which the Site refers.

10.2 I AM MY OWN LEGEND authorizes the placement of hyperlinks to any page or document on its Site, provided that they comply with applicable regulations, and in any case, the following cumulative conditions: The source that will point directly to the targeted Content via a hyperlink must be specified; The Content used is only for personal, educational, associative, or professional purposes; any use for commercial or advertising purposes is prohibited.  

Personal Data

In order to preserve the security of the content, I AM MY OWN LEGEND collects information on the use thereof (time and times of connection of the User, number of devices used, etc.). For any information regarding the processing of personal data, Users and Members can consult the personal data and cookies charter by clicking here.

Duration

These ToU bind I AM MY OWN LEGEND and a User or Member upon their acceptance by the latter. In case of refusal, the User or Member agrees to stop using the Site and the Services offered. This contractual document is concluded for the entire duration of use of the Site and Services. Non-compliance with any of the obligations herein will result, without formality or prior notice to the Member concerned, and without prejudice to any damages for I AM MY OWN LEGEND: in the immediate termination of the contract between I AM MY OWN LEGEND and the User or the Member; in the immediate deactivation of the User's or Member's access to the service and interactive spaces.

Miscellaneous Provisions

If any of the provisions of these Terms of Use were declared null or inapplicable pursuant to a law, regulation, or following a final court decision, it would be deemed unwritten, and the other provisions would remain in force.  

Applicable Law and Dispute Resolution

These ToU and any dispute arising out of or relating to them, their subject matter, or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.  

Any dispute, controversy, or claim arising out of or relating to these ToU, their subject matter, or formation (including non-contractual disputes or claims) shall be finally settled by arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The seat of arbitration shall be in the State of Delaware. The language of the arbitration shall be English.  

OR, ALTERNATIVELY, FOR COURT JURISDICTION: These ToU are subject to Delaware law.

In the event of a dispute relating to this Agreement, whether it concerns its interpretation, execution or termination, I AM MY OWN LEGEND and the User or the Member will endeavor to settle said dispute amicably prior to any legal action.

Failing an amicable resolution, the courts of Delaware will have jurisdiction according to the applicable rules of procedure. IMPORTANT CHANGES MADE FOR DELAWARE LAW COMPLIANCE:

• Governing Law and Jurisdiction: Explicitly stated that Delaware law governs the ToU and specified either arbitration under AAA rules in Delaware or that Delaware courts have jurisdiction. This is crucial for enforceability.

• Removed French Law References: Removed all references to specific French laws and replaced them with general principles applicable in Delaware.

• Modified Dispute Resolution: Added an option for binding arbitration under AAA rules, a common and favored method in the U.S., and specifically Delaware. Also offered an alternative specifying court jurisdiction if arbitration is not chosen.

• Liability: Modified to align with common U.S. practices regarding limitations of liability.

• Severability: Ensured the severability clause is in line with standard U.S. legal practice.

• Contract Formation: Adapted language to reflect standard U.S. contract law principles regarding offer, acceptance, and consideration.

• General Tone and Style: Adjusted the overall tone and style to be consistent with U.S. legal documents.

• Force Majeure: Modified the Force Majeure clause to align with general understanding in U.S. law.

• Member Publications: Made clear that the member retains ownership of the content they create and publish, but the site can use it on the site and social media.

• Notice of Illegal Activity: Simplified the process for reporting illegal activity.

• No Public Performances: Added a clause prohibiting the use of the service for public performances.

• No Class Action (Important): If you include an arbitration clause, it is strongly advised that you also include a class action waiver to prevent class action lawsuits or arbitrations.
